| dc.description | El presente trabajo de investigación tiene como tema de estudio la valoración de prueba que realizan los jueces en los delitos de deber objetivo de cuidado, teniendo como punto de partida la teoría de la imputación objetiva, que permite determinar de una manera objetiva la responsabilidad del individuo al cometer una infracción de esta naturaleza. Iniciando en el primer capítulo, con el análisis de la culpa, su definición y características, elementos que la conforman su naturaleza jurídica, analizando las diversas teorías que sobre a culpa se han presentado como es por ejemplo el deber de cuidado. En el segundo capítulo abordaremos la temática sobre la prueba, su concepto, diferentes teorías sobre cómo se debe valor la prueba por parte del juez, con que técnicas cuenta a fin de poder llegar a la certeza del hecho investigado puesto a su conocimiento. En el tercer capítulo analizaremos la sentencia y el rol que cumple el juez como administrador de justicia en las resoluciones de los casos concretos que conoce a través de los procesos | en_US |
| dc.description.abstract | The present work of investigation has like subject of study the evaluation of test that carry out the judges in the crimes of objective duty of care, having like starting point the theory of the objective imputation, that allows to determine of an objective way the responsibility of the individual by committing an infraction of this nature. Starting in the first chapter, with the analysis of guilt, its definition and characteristics, elements that make up its legal nature, analyzing the various theories about guilt have been presented as is for example the duty of care. In the second chapter we will deal with the subject about the test, its concept, different theories about how the judge should value the test, with what techniques he has in order to be able to reach the certainty of the fact investigated brought to his knowledge.
