dc.descriptionEl Ecuador es un Estado constitucional, de derechos y justicia, en el cual se garantiza a todos y cada uno de sus ciudadanos y ciudadanas el acceso gratuito a la administración de justicia y la tutela judicial efectiva, imparcial y expedita de sus derechos. El fiel cumplimiento y correcta aplicación de los derechos antes mencionados no estarían garantizados en su totalidad por el Estado ecuatoriano a causa del último inciso del artículo 324 del Código Orgánico General de Procesos. Inciso en el que se dispone que, posterior a la calificación a la demanda de acciones de impugnación de obligaciones tributarias, se rinda una caución equivalente al 10% del valor total en un plazo de veinticinco días, caso contrario se entenderá como no presentada lo que acarreará el archivo de la causa. Dicha disposición normativa trajo consigo numerosas dudas a los administradores de justicia acerca de verdadero alcance constitucional y la correcta aplicación de la misma, dando paso a la interposición de una demanda de acción pública de inconstitucionalidad presentada ante la Corte Constitucional en fecha 06 de noviembre de 2015. El presente trabajo de titulación aborda un estudio detallado del caso No. 92- 15-IN de la Corte Constitucional en el cual se determinó la inconstitucionalidad del último inciso del artículo 324 del Código Orgánico General de Procesos, así como también un examen doctrinario referente al derecho de acceso gratuito a la administración de justicia, la tutela judicial efectiva y la caución en materia tributaria. Del mismo modo, se realiza un análisis de las posturas de cada una de las partes procesales y la decisión tomada por parte de la Corte Constitucional como máximo órgano de interpretación y control constitucional reflejada en la sentencia No. 92- 15-IN/21 dentro de la presente causa.en_US
dc.description.abstractEcuador is a constitutional State of rights and justice, in which each and every one of its citizens is guaranteed with free access to the administration of justice and effective, impartial or unimpeded judicial protection of their rights. The faithful fulfillment and correct application of the aforementioned rights would not be fully guaranteed by the Ecuadorian State due to the last paragraph of article 324 of the Código Orgánico General de Procesos. Section in which it is provided that, after the qualification of the claim for actions challenging tax obligations, a bond equivalent to ten percent of the total value must be posted within a period of twenty-five days, otherwise it will be understood as not filed, which will result in the case being filed. This normative provision brought numerous doubts to the administrators of justice about the true constitutional scope and the correct application of the same, giving way to a public action of unconstitutionality filed on the Constitutional Court on November 06, 2015. This thesis is a detailed study of case No. 92-15-IN of the Constitutional Court in which the last paragraph of article 324 of the Código Orgánico General de Procesos was determined to be unconstitutional, as well as a doctrinal examination of the right to free access to the administration of justice, effective judicial protection and bail in tax matters.Likewise, an analysis is made of the positions of each of the procedural parties and the decision taken by the Constitutional Court as the highest body of interpretation and constitutional control reflected in Ruling No. 92-15-IN/21 in the present case.en_US
