| Abstract: | In this work a legal and social analysis will be carried out on the Higher Interest of the Child in the Adoption processes, in its Administrative and Judicial phases in the city of Cuenca, in such a way that we will mention the children and adolescents, who are the holders of this right; State institutions responsible for guaranteeing the principle of the Higher Interest of Children and Adolescents, such as: the Ministry of Economic and Social Inclusion (MIES), through its Technical Adoption Units and the Family Assignment Committees, who are in charge of the adoption process in its administrative phase, the Judges and Judges of the Family, Women, Childhood and Adolescence Unit in charge of the Judicial phase, likewise the historical development will be analyzed, in order to reach the principle of Higher Interest of the Child ; such a way that the research project aims to analyze if the Higher Interest of the Child is being guaranteed and protected in the Adoption processes in the city of Cuenca |
| Description: | En este trabajo se realizará un análisis jurídico y social sobre el Interés Superior del Niño en los procesos de Adopción, en sus fases Administrativa y Judicial en la ciudad de Cuenca, de tal manera que mencionaremos a los niños, niñas, y adolescentes, quienes son los titulares de este derecho; a las instituciones del Estado, encargadas de garantizar el principio de Interés Superior de los Niños, Niñas y Adolescentes , como son: el Ministerio de Inclusión Económica y Social (MIES), a través de sus Unidades Técnicas de Adopción y los Comités de Asignación Familiar , quienes se encargan del proceso de adopción en su fase administrativa, los Jueces y Juezas de la Unidad de Familia, Mujer, Niñez y Adolescencia encargados de la fase Judicial, de tal manera que en el proyecto de investigación se propone analizar si se está garantizando y protegiendo el Interés Superior del Niño en los procesos de Adopción en la ciudad de Cuenca |
