| Abstract: | This thesis, aims to explain and analyze in a total way the legal institution of Homestead, which appears with the sole purpose of protecting the family and ensuring its development, Homestead gives a real estate characteristics such as inalienable and indefeasible, in order to protect it of the creditors actions.
This legal institution is in the Constitution of the Republic, the Civil Code and special legislation, for that we talk about an institution in full force, which is unfortunately of little or no enforcement by the ignorance that society has on it, instead it has been very used by financial institutions that have the power to establish and terminate Homestead in real estate acquired through those institutions, to ensure the fulfillment of an obligation.
Different views and opinions have been issued about Homestead, for some authors it is an obstacle, and for others it is indisputable usefulness, under these criteria, this thesis seeks to rescue and highlight that utility and benefit that this institution carries, while a review is carried out at the way our legislation regulates this institution, which would be most useful and practical if it were better regulated and even more, if the Ecuadorian society know more about it. |
| Resumen : | La presente monografía, pretende explicar y analizar de manera total la institución jurídica del Patrimonio Familiar, la cual nace con el único fin de proteger a la familia y garantizar su desarrollo, el Patrimonio Familiar da a un bien inmueble características como inembargabilidad e inalienabilidad, con el objeto de protegerlo de las acciones de acreedores.
Esta institución jurídica se encuentra tanto en la Constitución de la República, en el Código Civil y en legislación especial, por ello hablamos de una institución en plena vigencia, la cual lamentablemente es de poca o ninguna aplicación por el desconocimiento que la sociedad tiene sobre ésta, en su lugar ha sido muy utilizada por parte de instituciones financieras que tienen la potestad de constituir y extinguir Patrimonio Familiar sobre bienes inmuebles adquiridos por medio de aquellas instituciones, a fin de asegurar el cumplimiento de la obligación.
Diversas opiniones y criterios se han emitido sobre el Patrimonio Familiar, para algunos autores se trata de una traba, y para otros es indiscutible su utilidad, bajo estos criterios, en la presente monografía se busca rescatar y resaltar aquella utilidad y beneficio que esta institución conlleva, al mismo tiempo que se realiza una crítica a la manera en que nuestra legislación regula esta institución, la cual sería de mayor utilidad y practicidad si estuviera mejor regulada y más aun, si la sociedad ecuatoriana conociera más sobre ésta. |
