| dc.description | La investigación reflejada en el presente trabajo de titulación está dirigida al análisis de una posible vulneración de derechos de los padres adoptantes con respecto a los hijos adoptados, en específico de los referentes a la herencia. El artículo sujeto a estudio y, el que contiene esta posible desigualdad, es el 327 del Código Civil ecuatoriano. Este precepto exhibe dos instituciones jurídicas, de las cuales su observación es indispensable para una conclusión clara. La primera es la Adopción, la que otorga a los adoptados y a los adoptantes las mismas prerrogativas y deberes recíprocos como si su vínculo fuera de sangre. Por otro lado, la Sucesión por Causa de Muerte, excluye los derechos hereditarios de aquellos que confiere la adopción. Entonces es necesario comparar estas figuras y las normas que las regulan, esto quiere que se analizará el Código Civil y el Código Orgánico de la Niñez y Adolescencia, teniendo en cuenta el texto constitucional vigente, concluyendo si existe o no tal desigualdad y de ser positiva esta respuesta, proponer una reforma al contenido del mencionado artículo 327 del Código Civil. | en_US |
| dc.description.abstract | The research reflected in this degree work is directed to the analysis of a possible violation of the rights of the adopting parents with respect to the adopted children, specifically those related to inheritance. The article subject to study, and the one that contains this possible inequality, is Article 327 of the Ecuadorian Civil Code. This precept exhibits two legal institutions, whose observation is indispensable for a clear conclusion. The first one is Adoption, which grants the adoptees and the adopters the same reciprocal prerogatives and duties as if their bond were of blood. On the other hand, Succession by Cause of Death, excludes the hereditary rights of those conferred by adoption. So it is necessary to compare these figures and the norms that regulate them, this means that the Civil Code and the Organic Code of Childhood and Adolescence will be analyzed, taking into account the current constitutional text, concluding whether or not such inequality exists and if this answer is positive, proposing a reform to the content of the aforementioned article 327 of the Civil Code. | en_US |
