| dc.description | La presente investigación se enmarca en el análisis de la comunidad LGBTI, y su lucha histórica, que ha propiciado avances hacia el reconocimiento de varios derechos en el ámbito del Sistema Interamericano de los Derechos Humanos. Durante décadas la comunidad de personas LGBTI, han estado sometidas a diferentes hechos de discriminación y vulneraciones a sus derechos humanos, debido a los diferentes estigmas o prejuicios que han persistido en las sociedades, bajo ese marco, la investigación en un primer momento identificará los avances y desafíos que permitieron el reconocimiento del colectivo, además de un análisis de manera específica a la progresividad de los derechos a la igualdad y no discriminación del colectivo LGTBI, y la línea jurisprudencial de la Corte Interamericana de Derechos Humanos, de manera concreta a los casos en materia de discriminación por: identidad de género, orientación sexual y expresión de género. Finalmente revisaremos cuál es la situación actual en cuanto a derechos del colectivo LGTBI en la región; lo que implica un antes y un después en el ámbito del desarrollo de los derechos a la igualdad y la no discriminación de la comunidad LGTBI. | en_US |
| dc.description.abstract | This research is framed in the analysis of the LGBTI community, and its historical struggle, which has led to progress towards the recognition of several rights in the framework of the Inter-American Human Rights System. For decades the LGBTI community has been subjected to different acts of discrimination and violations of their human rights, due to the different stigmas or prejudices that have persisted in societies. The present investigation will first identify the progress and challenges that allowed the recognition of the rights of LGBTI community, in addition to a specific analysis of the progressiveness of the right to equality and non-discrimination of LGBTI persons, and the jurisprudential line of the Inter-American Court of Human Rights, specifically in cases of discrimination based on gender identity, sexual orientation and gender expression. Finally, we will review the current situation of the rights of LGBTI persons in the Inter American Human Rights System, which represents a before and after in the recognition of the rights of equality and non-discrimination of the LGBTI community. | en_US |
