Evaluación de jueces y conjueces de Corte Nacional en el año 2019: ¿Mandato constitucional o injerencia en la justicia?

Abstract

The titling work "Evaluation of Judges and co-Judges of the National Court in 2019: Constitutional mandate or interference in justice?", presents us with a legal problem of current relevance, since, in the recent history of Ecuador since the Returning to democracy, the Ecuadorian judiciary has been compromised by different political and economic interests. In this context, what the author seeks with his research work is to expose the current situation of the Ecuadorian justice system, analyze the regulations created for the last evaluation carried out at the highest Court of Justice in the country, examine it in light of the Constitution of the Republic of Ecuador and its agreement with the block of constitutionality. After that, the author tries a new way of evaluating judicial servants, based on parameters that arise from personal interviews with experts, in addition to collecting different points of view from professors, doctrinaires and figures related to Ecuadorian legal work, observing the existing international regulations for the case, all this with the purpose of consolidating an efficient and effective Institution that prevents the country from continuing to be sentenced in International Courts, creating legal uncertainty and international responsibility, in addition to being obliged to compensate the injured in millions.
