| dc.description | El acoso laboral ha sido implementado en nuestro ordenamiento jurídico a través de la “Ley Orgánica Reformatoria a la Ley Orgánica del Servicio Público y al Código del Trabajo para prevenir el Acoso Laboral” en el año 2017, como una figura que responde a la necesidad de contar con una regulación específica, detallada y cautelar para auxiliar a los trabajadores que son víctimas del mismo, sin embargo se presentan varias deficiencias que no permiten su aplicación efectiva. De modo que en base a entrevistas e instrumentos doctrinarios y jurisprudenciales se ha realizado un análisis sobre las posibles reformas de las que puede ser objeto esta institución jurídica, con la finalidad de trazar un ámbito preventivo y una regulación integral que pueda combatir con la complejidad que conlleva la denuncia de estos casos, para así obtener conforme a lo analizado, un criterio que permita englobar todas las deficiencias en la normativa del acoso laboral. | en_US |
| dc.description.abstract | Labor harassment has been implemented in our legal system through the "Ley Orgánica Reformatoria a la Ley Orgánica del Servicio Público y al Código del Trabajo para prevenir el Acoso Laboral" in 2017, as a figure that responds to the need to have an specific, detailed and precautionary regulation to assist workers who are victims of it, however there are several deficiencies that do not allow a comprehensive treatment of it. So, based on interviews and doctrinal and jurisprudential instruments, an analysis has been made on the possible reforms of which this legal institution can be the object with the purpose of outlining a preventive scope and a comprehensive regulation that can fight with the complexity that entails the denunciation of these cases, in order to obtain according to the analyzed, a legal criterion that allows to encompass all the deficiencies in the regulation of labor harassment in order to be able to raise the necessary reforms. | en_US |
