| dc.description | El presente trabajo tiene como objetivo, realizar un análisis de los efectos jurídicos que surgen de la omisión del Administración Pública ante las peticiones de los administrados según el Código Orgánico Administrativo, esta figura resulta transcendental porque ha generado efectos que por regla general en nuestra legislación será positivo y como excepción negativa. El estudio inicia con el derecho de petición como fundamento del silencio administrativo ya que la Constitución del Ecuador 2008 exige una respuesta motivada ante las pretensiones o solicitudes de los administrados; además, se identificará sus requisitos y su origen para que el acto administrativo presunto que nace del silencio administrativo sea válido y legítimo.
