La credibilidad del testimonio de la víctima adolescente en el delito de violación en el Ecuador

Abstract

The purpose of this research project is to determine the evidentiary assessment criteria used by justice operators in our country when assessing the testimony of the adolescent victim in the crime of rape in Ecuador. For this, the Institution of the evidence and its effectiveness in the Comprehensive Organic Penal Code are analyzed with emphasis on the testimonial evidence of the victim under 14 years of age in the crime of rape in the Ecuadorian criminal system as well as the influence of the principle of Superior Interest of the child or adolescent as a reference in the motivation of convictions for the crime of rape in Ecuador. At the end of this investigation, two judgments issued by the Criminal, Military and Police Chamber of the National Court of Justice are examined regarding the credibility of the testimony of the 14-year-old adolescent victim in the crime of rape.
