Abstract

The following research deepens the analysis and the understanding about dismissal in Ecuador. At first time it´s delimited, types are differentiated and it´s examined how the dismissal is regulated on the Ecuadorian and the International Law. In the second section is addressed the burden of the proof on the Labour Law and focuses on the dismissal uncaused, emphasizing the aggravated dismissal, which have been recently protected in this country. Finally ponders about the tutelary principle in the labour standard, both in the substantive and in the adjective, analyzing concepts like reinforced stability, the regulation, flexibility and flexisecurity
