Responsabilidad penal de las personas jurídicas en el delito de propiedad intelectual

Abstract

In this document we analyze the figure of the criminal responsibility of the juridical person in the crime against the intellectual property, analysis that starts from the evaluation of the criminally relevant conduct against the intellectual property in Ecuador. The work seeks to establish if the penal type, which is established around copyrights and product brands, has some basis, considering that the criminal type was not originally incorporated into the Código Orgánico Integral Penal COIP in 2014, and it had to be incorporated through a reform proposed in 2015. In this reform, was included the criminal responsibility of the juridical person, analyzing in this aspect, the imputation system that would be applied in Ecuador.
