| Abstract: | This research project entitled "THE RIGHT TO A WORTHY DEATH AND THE NEED TO LEGALIZE EUTHANASIA IN ECUADOR", is an important part of scientific and social developments, policy worldwide at the present time we are living, is for this reason that the present investigation is aimed at encouraging the legalization of Active and Passive Euthanasia in the country.
From a thorough analysis within this research I will focus on the legal grounds that support euthanasia as a right future we could enjoy all ecuadorian citizens, with the Constitution of the Republic and the Treaty of Human Rights, the main sources feeding this possible law and comparative law regarding the law allowing euthanasia in the Netherlands, Belgium, Switzerland and other international legal sources, in conjunction with the principles and rights enshrined in the Constitution, such as: human dignity, Good living, and Autonomy of the will, which allow the full development of personality, and the freedom to enjoy life to its fullest extent, so that is considered to be human owner and author of your destination, respecting their way of thought, belief, and above all their decisions, but putting as its limit the right and respect of others. |
| Resumen : | El presente proyecto investigativo titulado “EL DERECHO A UNA MUERTE DIGNA Y LA NECESIDAD DE LEGALIZAR LA EUTANASIA EN EL ECUADOR”, forma parte importante de la evolución científica, política y social que a nivel mundial en los momentos actuales estamos viviendo, es por esta razón, queesta investigación se encuentra encaminada a incentivar la legalización de la Eutanasia Activa y Pasiva en el país.
A partir de un profundo análisis dentro del proyecto, haré énfasis en los fundamentos legales que sostienen a la Eutanasia como un futuro derecho del que podríamos gozar todos los ciudadanos ecuatorianos, siendo la Constitución de la República y el Tratado de los Derechos Humanos, las principales fuentes que alimentan este posible derecho, así como el Derecho comparado en relación a la Ley que permite la Eutanasia en Holanda, Bélgica, Suiza y otras fuentes jurídicas internacionales, en conjunción con los principiosconsagrados en la Carta Magna, tales como: la Dignidad Humana, el Buen Vivir, y la Autonomía de la Voluntad, los cuales permiten el desarrollo pleno de la personalidad, así como la libertad para disfrutar de la vida en toda su extensión, de tal forma que se considera al ser humano dueño y autor de su destino, respetando su forma de pensamiento, credo, y sobre todo sus decisiones, pero poniendo como límite el derecho y respeto de los demás. |
